Acceptance of Terms

By creating an account or using betaspotter.com, you agree to these Terms of Service and our Privacy Policy. If you disagree with any part, you may not use our service. These terms apply to all users: Spotters, Founders, and visitors.

Eligibility

You must be at least 13 years old to use BetaSpotter. By using the platform you represent that:

• You are at least 13 years old
• You have the legal capacity to enter into a binding agreement
• You are not banned from using BetaSpotter under any previous enforcement action

Account Responsibilities

• You are responsible for keeping your password secure
• You must not share your account with others
• You must provide accurate information when registering
• You must notify us immediately at hello@betaspotter.com if you suspect unauthorised access
• You are responsible for all activity that occurs under your account

Spotter Rules

As a Spotter (tester), you agree to:

• Only apply to betas you genuinely intend to test
• Submit honest, constructive, and specific feedback — not placeholder or AI-generated text
• Keep beta product details confidential unless the founder has made them public
• Not use beta access to clone, reverse-engineer, or compete with the product
• Respect founders and other community members in all communications

Repeated no-shows (applying and never providing feedback) may result in account restrictions.

Founder Rules

As a Founder (maker), you agree to:

• Only list products you have built or have authority to represent
• Provide accurate descriptions — no misleading claims about features or status
• Respond to approved Spotters within a reasonable time
• Not use Spotter contact details for any purpose outside the beta testing relationship
• Not list products that violate laws, infringe intellectual property, or violate our content rules

Prohibited Content

You may not submit, list, or share content that:

• Is illegal, fraudulent, or deceptive
• Infringes patents, trademarks, copyrights, or trade secrets
• Is pornographic, hateful, harassing, or violent
• Contains malware, spyware, or any malicious code
• Constitutes spam or unsolicited commercial communications
• Impersonates any person or organisation
• Violates anyone's privacy or publicity rights

Intellectual Property

You retain ownership of content you submit (feedback, product descriptions, profile information). By submitting content, you grant BetaSpotter a worldwide, royalty-free licence to display and distribute it on the platform.

BetaSpotter's name, logo, and original code are our intellectual property. You may not use them without written permission.

Subscriptions & Payments

Founder plans (Starter, Growth, Pro) are billed monthly or annually. By subscribing:

• You authorise us to charge your payment method on a recurring basis
• Cancellation takes effect at the end of the current billing period — no prorated refunds
• We reserve the right to change pricing with 30 days' notice to paying subscribers
• Free plan users have no payment obligation

Termination

You may delete your account at any time from Settings. We may suspend or terminate your account if you violate these terms, with or without notice depending on severity. On termination:

• Your access to the platform ceases immediately
• Your profile data is deleted per our Privacy Policy
• Outstanding subscription fees remain due

Disclaimers & Limitation of Liability

BetaSpotter is provided "as is" without warranties of any kind. We do not guarantee that the platform will be uninterrupted, error-free, or that results from using it will meet your expectations.

To the fullest extent permitted by law, BetaSpotter's total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months before the claim.

Governing Law

These Terms are governed by the laws of the jurisdiction in which BetaSpotter is registered, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration unless you opt out within 30 days of account creation by emailing legal@betaspotter.com.

Changes to These Terms

We may update these Terms. We will notify you by email at least 14 days before significant changes take effect. Continued use after the effective date constitutes acceptance.
